Through an in-depth comparative analysis of landmark United States Supreme Court decisions — including Marbury v. Madison, Goldwater v. Carter, Roe v. Wade, and Marconi Wireless Tel. Co. v. United States — the thesis explores the progressive expansion of constitutional courts’ functional role and its systemic implications. The analysis is grounded in the philosophical frameworks of John Rawls and Ronald Dworkin and culminates in an advanced theoretical proposal centered on intergenerational justice and advocating for the introduction of preventive constitutional review mechanisms and reforms.

Iorio’s doctoral research in Criminal Law is based on Artificial Intelligence and Cybersecurity and aims to explore how existing legal basic-structures and institutional frameworks are manifestly anachronistic when faced with AI, algorithmic decision-making, deep learning, generative patterns, and emerging quantum technologies. In this perspective, Law must move from a purely reactive and regulatory role to a leading, predictive and structural one in order to preserve legal certainty and safeguard fairness, equity, efficiency, and institutional legitimacy as well as to prevent disparities of treatment and probable systemic imbalances in the administration of justice. Only a coordinated, constitutionally grounded, and internationally harmonized preventive Leading role of the Law can prevent the emergence of zones of de facto impunity and preserve the rule of law in the age of artificial intelligence. The research adopts a comparative and analytical approach to “International Criminal Law” and regulatory governance, proposing innovative treaty-based frameworks and legal remedies addressing regulatory gaps, weak legal systems, judicial equity, legality, and intergenerational justice, including ethical and compliance challenges arising from the global dominance of large, currently underregulated Big Tech corporations.
